The Commentary "Or
HaChayim"

Moses ibn
Attar, 1696-1743, b. Morocco) says that the case of the Captive Woman occurred
when the Israelite warrior saw a woman amongst the captives with an Israelite
soul and so redeems her by forcing her to become an Israelite and marry him.
Other commentaries are critical of the whole concept.
Some say that in ancient times it was accepted practice all over the world that
a conquering army would have its own way with the conquered women. The would be
male lover-boy had to go through a whole rigmarole of having to do this and that
and take responsibility for his captive. The end result would have been to
reduce the temptation for rape, induced fornication, or welcome promiscuity. At
the same time the Torah did not close the door altogether and allowed some form
of sexual union with the defeated enemy.
[Deuteronomy 21:12] THEN THOU SHALT BRING HER HOME TO THINE HOUSE, AND SHE SHALL
SHAVE HER HEAD, AND PARE HER NAILS;

The right of the firstborn belongs to
the firstborn. His father cannot take it from him.
[Deuteronomy 21:18] IF A MAN HAVE A STUBBORN AND REBELLIOUS SON, WHICH WILL NOT
OBEY THE VOICE OF HIS FATHER, OR THE VOICE OF HIS MOTHER, AND THAT, WHEN THEY
HAVE CHASTENED HIM, WILL NOT HEARKEN UNTO THEM:
[Deuteronomy 21:19] THEN SHALL HIS FATHER AND HIS MOTHER LAY HOLD ON HIM, AND
BRING HIM OUT UNTO THE ELDERS OF HIS CITY, AND UNTO THE GATE OF HIS PLACE;
[Deuteronomy 21:20] AND THEY SHALL SAY UNTO THE ELDERS OF HIS CITY, THIS OUR SON
IS STUBBORN AND REBELLIOUS, HE WILL NOT OBEY OUR VOICE; HE IS A GLUTTON, AND A
DRUNKARD.
[Deuteronomy 21:21] AND ALL THE MEN OF HIS CITY SHALL STONE HIM WITH STONES,
THAT HE DIE: SO SHALT THOU PUT EVIL AWAY FROM AMONG YOU; AND ALL ISRAEL SHALL
HEAR, AND FEAR.

LOST, AND THOU HAST FOUND, SHALT THOU DO LIKEWISE: THOU MAYEST NOT HIDE

[Deuteronomy 22:4] THOU SHALT NOT SEE THY BROTHER'S ASS OR HIS OX FALL DOWN BY
THE WAY, AND HIDE THYSELF FROM THEM: THOU SHALT SURELY HELP HIM TO LIFT THEM
UP AGAIN.
[Deuteronomy 22:5] THE WOMAN SHALL NOT WEAR THAT WHICH PERTAINETH UNTO A MAN,
NEITHER SHALL A MAN PUT ON A WOMAN'S GARMENT: FOR ALL THAT DO SO ARE ABOMINATION
UNTO THE LORD THY GOD.
Men and women were forbidden to wear
each others clothing.
The Sages extended this to forbid a man in general to behave like a woman.
[Deuteronomy 22:6] IF A BIRD'S NEST CHANCE TO BE BEFORE THEE IN THE WAY IN ANY
TREE, OR ON THE GROUND, WHETHER THEY BE YOUNG ONES, OR EGGS, AND THE DAM SITTING
UPON THE YOUNG, OR UPON THE EGGS, THOU SHALT NOT TAKE THE DAM WITH THE
YOUNG:
[Deuteronomy 22:7] BUT THOU SHALT IN ANY WISE LET THE DAM GO, AND TAKE THE YOUNG
TO THEE; THAT IT MAY BE WELL WITH THEE, AND THAT THOU MAYEST PROLONG THY DAYS.

[Deuteronomy 22:10] THOU SHALT NOT PLOW WITH AN OX AND AN ASS TOGETHER.
OX. Hebrew "shor"
i.e. male bull.
ASS. Hebrew "chamor"
i.e. male donkey.
This practice was evidently common until recently amongst the Arab Palestinians.
The word translated here as "ox" in Hebrew is "shor"
meaning bull. Ox in English connotes a steer or castrated bull whereas the
original Hebrew has "shor"
meaning simply a bull who was not castrated.
A bull is much stronger than an ass and naturally workers harder and faster. By
binding them together it was possible to get much more work out of the ass. The
Torah forbade this.
[Deuteronomy 22:11] THOU SHALT NOT WEAR A GARMENT OF DIVERS SORTS, AS OF WOOLLEN
AND LINEN TOGETHER.
I understand that most Scottish kilts
are made out of a mixture of linen and wool. The linen adds strength and some
water-resistance.

The combination in clothing
of wool and linen is forbidden. Such mixtures in Hebrew are known as
Shatnez.
Most major clothing importers in Israel have the produce checked for
Shatnez.
In one case a line of dressing gowns with
shatnez
in them reportedly slipped into the country. The importers and their outlets
immediately replaced all gowns brought into them.
In addition throughout Israel one finds
shatnez
laboratories that will check items of clothing for a modest fee. These are run
by Ultra-Orthodox specialists. Lately due to a few bad eggs the Ultra-Orthodox
have been receiving a bad press.
Reality "on the ground" however shows that most Israelis as well as Arabs "in
the know" prefer to do business with the Ultra-Orthodox instead of their own
kind.
An anecdote from a very reliable source relates:
A group of Ultra-Orthodox (Haredi) families bought, by bulk purchase, a number of flats in a certain neighborhood. A secular woman in the area became very active in organizing resistance to the coming of these families since she feared an overly drastic change to the neighborhood might result.[Deuteronomy 22:12] THOU SHALT MAKE THEE FRINGES UPON THE FOUR QUARTERS OF THY VESTURE, WHEREWITH THOU COVEREST THYSELF.
An Ultra-Orthodox Rabbi took the lady aside and asked her.

[Deuteronomy 23:3] AN AMMONITE OR MOABITE SHALL NOT ENTER INTO THE

Male Ammonites and Moabites were
forbidden but females were permitted.
This is why Ruth the Moabitess
and ancestress of King David was able to become a member of the Israelite
Nation.

When you go to war you should keep
yourself as pure and as unsullied as possible. There are those who try and give
the impression that dirty language and immodest behavior is more manly. This is
a delusion. Manliness begins with self-respect or at least with respect for
basic codes of conduct.
[Deuteronomy 23:10] IF THERE BE AMONG YOU ANY MAN, THAT IS NOT CLEAN BY REASON
OF UNCLEANNESS THAT CHANCETH HIM BY NIGHT, THEN SHALL HE GO ABROAD OUT OF THE

NO WHORE. From here the Rabbis learned a
general prohibition against illicit sex
even when those concerned were not married. Promiscuity was forbidden.
[Deuteronomy 23:18] THOU SHALT NOT BRING THE HIRE OF A WHORE, OR THE PRICE OF A
DOG, INTO THE HOUSE OF THE LORD THY GOD FOR ANY VOW: FOR EVEN BOTH THESE ARE

This Law actually only applied to
someone who was working in the field of another.

DILIGENTLY, AND DO ACCORDING TO ALL THAT THE PRIESTS THE LEVITES SHALL TEACH
YOU: AS I COMMANDED THEM, SO YE SHALL OBSERVE TO DO.
[Deuteronomy 24:9] REMEMBER WHAT THE LORD THY GOD DID UNTO MIRIAM BY THE WAY,
AFTER THAT YE WERE COME FORTH OUT OF EGYPT.
[Deuteronomy 24:10] WHEN THOU DOST LEND THY BROTHER ANY THING, THOU SHALT NOT GO
INTO HIS HOUSE TO FETCH HIS PLEDGE.
[Deuteronomy 24:11] THOU SHALT STAND ABROAD, AND THE MAN TO WHOM THOU DOST LEND
SHALL BRING OUT THE PLEDGE ABROAD UNTO THEE.
[Deuteronomy 24:12] AND IF THE MAN BE POOR, THOU SHALT NOT SLEEP WITH HIS

SHOULD EXCEED, AND BEAT HIM ABOVE THESE WITH MANY STRIPES, THEN THY BROTHER
SHOULD SEEM VILE UNTO THEE.
[Deuteronomy 25:4] THOU SHALT NOT MUZZLE THE OX WHEN HE TREADETH OUT THE CORN.
[Deuteronomy 25:5] IF BRETHREN DWELL TOGETHER, AND ONE OF THEM DIE, AND HAVE NO
CHILD, THE WIFE OF THE DEAD SHALL NOT MARRY WITHOUT UNTO A STRANGER: HER
HUSBAND'S BROTHER SHALL GO IN UNTO HER, AND TAKE HER TO HIM TO WIFE, AND
PERFORM THE DUTY OF AN HUSBAND'S BROTHER UNTO HER.
[Deuteronomy 25:6] AND IT SHALL BE, THAT THE FIRSTBORN WHICH SHE BEARETH SHALL
SUCCEED IN THE NAME OF HIS BROTHER WHICH IS DEAD, THAT HIS NAME BE NOT PUT OUT
OF ISRAEL.
[Deuteronomy 25:7] AND IF THE MAN LIKE NOT TO TAKE HIS BROTHER'S WIFE, THEN LET
HIS BROTHER'S WIFE GO UP TO THE GATE UNTO THE ELDERS, AND SAY, MY HUSBAND'S
BROTHER REFUSETH TO RAISE UP UNTO HIS BROTHER A NAME IN ISRAEL, HE WILL NOT
PERFORM THE DUTY OF MY HUSBAND'S BROTHER.
[Deuteronomy 25:8] THEN THE ELDERS OF HIS CITY SHALL CALL HIM, AND SPEAK UNTO
HIM: AND IF HE STAND TO IT, AND SAY, I LIKE NOT TO TAKE HER;
[Deuteronomy 25:9] THEN SHALL HIS BROTHER'S WIFE COME UNTO HIM IN THE PRESENCE
OF THE ELDERS, AND LOOSE HIS SHOE FROM OFF HIS FOOT, AND SPIT IN HIS FACE, AND
SHALL ANSWER AND SAY, SO SHALL IT BE DONE UNTO THAT MAN THAT WILL NOT BUILD UP
HIS BROTHER'S HOUSE.
[Deuteronomy 25:10] AND HIS NAME SHALL BE CALLED IN ISRAEL, THE HOUSE OF HIM
THAT HATH HIS SHOE LOOSED.
[Deuteronomy 25:11] WHEN MEN STRIVE TOGETHER ONE WITH ANOTHER, AND THE WIFE OF
THE ONE DRAWETH NEAR FOR TO DELIVER HER HUSBAND OUT OF THE HAND OF HIM THAT
SMITETH HIM, AND PUTTETH FORTH HER HAND, AND TAKETH HIM BY THE SECRETS:
[Deuteronomy 25:12] THEN THOU SHALT CUT OFF HER HAND, THINE EYE SHALL NOT PITY
HER.
[Deuteronomy 25:13] THOU SHALT NOT HAVE IN THY BAG DIVERS WEIGHTS, A GREAT AND A
SMALL.
[Deuteronomy 25:14] THOU SHALT NOT HAVE IN THINE HOUSE DIVERS MEASURES, A GREAT
AND A SMALL.
[Deuteronomy 25:15] BUT THOU SHALT HAVE A PERFECT AND JUST WEIGHT, A PERFECT AND
JUST MEASURE SHALT THOU HAVE: THAT THY DAYS MAY BE LENGTHENED IN THE LAND WHICH
THE LORD THY GOD GIVETH THEE.
[Deuteronomy 25:16] FOR ALL THAT DO SUCH THINGS, AND ALL THAT DO UNRIGHTEOUSLY,
ARE AN ABOMINATION UNTO THE LORD THY GOD.
[Deuteronomy 25:17] REMEMBER WHAT AMALEK DID UNTO THEE BY THE WAY, WHEN YE WERE
COME FORTH OUT OF EGYPT;
[Deuteronomy 25:18] HOW HE MET THEE BY THE WAY, AND SMOTE THE HINDMOST OF THEE,
EVEN ALL THAT WERE FEEBLE BEHIND THEE, WHEN THOU WAST FAINT AND WEARY; AND HE
FEARED NOT GOD.
#AND HE FEARED NOT GOD#. This is the
traditional accepted understanding
in accordance with how the Hebrew is read BUT it may alternately be read as
saying,
#AND YOU FEARED NOT GOD#. This was pointed out by the
Midrash
Sifrei.
In other words,
Because you did not fear God the enemy was able to come and attack you.
Nevertheless, even though your culpability in some sense may have induced this
attack upon you, you must still take vengeance!
WE some times hear concerning rape victims and the like, expressions such as,
"She was asking for it!"
Even if there is some truth in this the guilty party must still be punished and
the injured person has the right to take what revenge they can.
[Deuteronomy 25:19] THEREFORE IT SHALL BE, WHEN THE LORD THY GOD HATH GIVEN THEE
REST FROM ALL THINE ENEMIES ROUND ABOUT, IN THE LAND WHICH THE LORD THY GOD
GIVETH THEE FOR AN INHERITANCE TO POSSESS IT, THAT THOU SHALT BLOT OUT THE
REMEMBRANCE OF AMALEK FROM UNDER HEAVEN; THOU SHALT NOT FORGET IT.

Judah will return prior to
the Ten Tribes and prepare the way for them. Judah will rebuild the waste places
(54:3). God was angry but HE will yet have mercy (54:8).
[Isaiah 54:3] FOR THOU SHALT
BREAK FORTH ON THE RIGHT HAND AND ON THE LEFT; AND THY SEED SHALL INHERIT THE
GENTILES, AND MAKE THE DESOLATE CITIES TO BE INHABITED.
This is still mainly on Judah who will return prior to the Ten Tribes and
prepare the way for them. Judah will rebuild the waste places.
